On January 8, 2025, the U.S. Consumer Product Safety Commission (CPSC), in collaboration with U.S. Customs and Border Protection (CBP), introduced a Final Rule that revises regulations for Certificates of Compliance. This update aims to streamline compliance processes by aligning current regulations with existing testing and certification rules and implementing mandatory electronic filing (e-Filing) for regulated products.
The Final Rule updates 16 CFR Part 1110, specifying:
Entities required to issue certificates for finished products under the Consumer Product Safety Act (CPSA).
Content, form, and availability requirements for Certificates of Compliance.
Mandatory e-Filing of certificates with CBP for imported finished products.
Clarifications on component part certificates.
For most CPSC-regulated products, the rule takes effect on July 8, 2026.
For products imported from foreign trade zones (FTZ) for consumption or warehousing, the rule takes effect on January 8, 2027.
This regulatory change is critical for importers and manufacturers, as it introduces electronic filing requirements for Certificates of Compliance. The CPSC also released an e-Filing Quick Start Guide in July 2024 to assist businesses in adapting to these new processes.
